DMCA Policy

First For News respects the intellectual property rights of others and expects users of the Site to do the same. This DMCA Policy describes how the publication responds to notices of alleged copyright infringement under the U.S. Digital Millennium Copyright Act ("DMCA").

Notification of Alleged Infringement

If you believe that content published on the Site infringes your copyright, you may submit a notice of alleged infringement to our designated agent. To be effective under the DMCA, your notice must include all of the following:

1. A physical or electronic signature of a person authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.

2. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notice, a representative list of such works.

3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit the publication to locate the material (typically the URL of the specific article or page).

4. Information reasonably sufficient to permit the publication to contact you, including your name, address, telephone number, and email address.

5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

6. A statement that the information in the notification is accurate, and, under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Where to Send Notices

DMCA notices should be sent to the designated agent by email at [email protected], with the subject line "DMCA Notice."

Counter-Notification

If content you submitted has been removed or disabled in response to a DMCA notice, and you believe the removal was mistaken or based on misidentification, you may submit a counter-notification. To be effective, a counter-notification must include all of the following:

8. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.

9. A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.

10. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or, if your address is outside the United States, for any judicial district in which the publication may be found, and that you will accept service of process from the person who provided the original DMCA notice or an agent of such person.

Repeat Infringer Policy

The publication maintains a policy of terminating, in appropriate circumstances, the accounts of users who are determined to be repeat infringers of copyright.

Misrepresentations

Please be aware that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be liable for damages.
